ARTICLE 1 (Objective)
These Terms of Service (hereinafter referred to as “TOS”) concern necessary terms for the usage of the Wi-Fi Internet Service (hereinafter referred to as “Service”) of Yokosuka City Libraries (hereinafter referred to as “Library”) provided for the convenience of Users.
ARTICLE 2 (Administrator Terms)
1. In order to appropriately manage the Service, a Wi-Fi Administrator (hereinafter referred to as “Administrator”) will be assigned.
2. The Head Librarian of the Chuo Library shall serve as the Administrator.ARTICLE 3 (Usage Area and Usage Time)
1. This Service is available at the Chuo Library’s Reading Room, Adult Reading Room, Student Reading Room, and Refresh Room.
2. The Wi-Fi Internet Service is useable during the Chuo Library’s operating hours, but if deemed necessary, the Head Librarian has the authority to change the usage times without prior notification.ARTICLE 4 (User Agreement)
Users of this Service must agree to the TOS.
ARTICLE 5 (Service Conditions)
1. Through this Service, the User will be able to connect to the internet.
2. This Service is provided free of charge, but the User shall be responsible for any extra accrued costs while using the internet.
3. In order to utilize this Service, the User will need to prepare a Wi-Fi Compatible Device (hereinafter referred to as “Device”). The User will need to bring their own Chargers/Adapters for their Device.
4. Device Settings for connecting to the Service will be handled by the User. Technical matters related to the settings will be directed to a contact designated by the Library.ARTICLE 6 (Service Provider)
This Service uses “Gigaraku Wi-Fi” provided by Nippon Telegraph and Telephone East Corporation.
ARTICLE 7 (Conditions of Usage)
1. The User shall avoid disturbing other library users through actions including, but not limited to, muting the Device or by using headphones
2. When using the Service, the User shall obey the “Act of Prohibition on Unauthorized Computer Access” (Act No. 128 of Year 1999) and other related laws.
3. Usage of the Service by minors (under 18 years old) shall comply with the “Act on Development of an Environment that Provides Safe and Secure Internet Use for Minors” (Act No. 79 of Year 2008). Parents or guardians shall be responsible for supervising content viewed on their child’s Devices.
4. The User shall be responsible for securing their own personal data stored on their Device.
5. The Library has the authority to modify the Service without the User’s agreement.ARTICLE 8 (Usage and Protection of User Information)
Personal information of the User, acquired by the Library through the registration of the Service or during usage of the Service, will be kept by Nippon Telegraph and Telephone East Corporation and used for authentication when Users use the service. Foregoing information shall be managed appropriately according to the privacy policy of Nippon Telegraph and Telephone East Corporation.

In order to prevent inappropriate usage of the Service, the Administrator has the authority to record the User’s browsing history and restrict access to websites.
ARTICLE 10 (Usage Termination)
The Administrator has the authority to immediately terminate the User’s access to the Service without prior notification if any of the following occur:
(1) The User commits a Prohibited Act
(2) The User violates the TOS provisions
(3) Any other use of the Service by the User is deemed inappropriate by the LibraryARTICLE 11 (Prohibited Acts)
1. The User shall not carry out the following actions while using the Service:
(1) Any action that violates or may violate the copyright and/or other rights of the Library and/or a third party
(2) Any action that causes or may cause damage, loss or detriment to the Library and/or a third party
(3) Any action that defame the Library and/or a third party
(4) Any action that is offensive or may be offensive to public order and morals, or any action that promotes offensive and immoral information
(5) Criminal action or any action that causes or may cause criminal action
(6) Any action relating to sex entertainment and/or proselytization; religious and/or political activities; and/or anything similar to its kind
(7) Providing or using harmful application/program including, but not limited to, computer viruses in connection with or relating to the Service
(8) Sending specific or nonspecific bulk mail for purposes including, but not limited to, mail order business, multilevel marketing, and/or business opportunity related transactions
(9) Usage of file sharing software, and/or uploading and/or downloading large volumes of data
(10) Using this Service in such manner that causes serious disruption to other library users including, but not limited to, disruptive noises and/or Device sounds
(11) Any other action that is or may be unlawful
2. If the User has committed an action previously defined to cause damage or loss to the Library, other users, and/or a third party, the User shall take its liability including, but not limited to, compensation of damage or loss caused by such action, and shall not inflict the City by all means.ARTICLE 12 (Service Suspension)
The Administrator may suspend the Service for the following reasons:
(1) When system maintenance takes place whether periodically or emergently
(2) When the Service cannot be operated and provided due to an emergency or disaster including, but not limited to, rebellion, riot, labor dispute, earthquake, volcanic eruption, flooding, tsunami, fire, or electric power failure
(3) When the Service cannot be operated and provided due to reasons including, but not limited to, complications with the Service system equipment or network
(4) When the Administrator decides that pausing the Service is necessary due to the operational reasonsARTICLE 13 (Limitation of Liability)
1. The Library shall not warrant any of the Service contents and information provided through the Service in terms of, but not limited to, completeness, accuracy, certainty, and usefulness.
2. The Library is not liable to any loss or damage incurred by providing, slowing down, modifying, suspending, or terminating the Service.
3. The Library is not liable to any loss or damage incurred to the User or a third party including, but not limited to, loss of User’s data that is registered, provided, and/or collected with the Service, damage to the User’s Device due to a computer virus, data corruption, and/or data leak.
4. The Library is not liable to the inability of Service usage due to, but not limited to, the User’s Device, any software, and/or web browsers.
5. The Library takes no responsibility for a dispute arising out between the User and other users or any third party relating to or in connection with using this Service.ARTICLE 14 (Modification of the TOS)
The Administrator may modify the TOS without the User’s agreement. Modification of the TOS will be reported to the User beforehand.
SUPPLEMENTARY PROVISIONS
This TOS is effective as of July 1, 2018.
